Parade of Champions

Having graduated from Lake Travis High School in 1985 and participated in the Cavalier’s first winning season, it was a great honor to co-coordinate the Parade of Champions Parade for the state champion Cavalier football team, state tournament volleyball team and state champion cheerleaders. This great community was successful only because of the hard work of Amy Still, Abby Lazarus, the school administration, the multiple sponsors (Cavalettes, band, cheer, volleyball), the coaches, the players, the Galleria, the City of Bee Cave, the City of Lakeway and all of the individuals who used their classic cars in the parade. Other than the obvious glory the athletes and coaches received, the Lake Travis area as a whole derived the rare sensation of living in a small-town community. Thousands of spectators cheered as the teams made their way down the Main street of the Galleria and up to City Hall for awards and presentations. A few of the photographs are attached to this blog.

Matbon, Inc., et al v. Gries

Attached please find a copy of Matbon, Inc., et al v. Gries recently decided by the Eastland Court of Appeals regarding the application of Texas Civil Practice and Remedies Code 41.0105. As you know, this is often referred to as “HB4”. Defense attorneys frequently encounter plaintiff’s lawyers who argue that the statute is either unenforceable or that the very language of the statute constituted no change in the pre-existing collateral source rule in place in Texas at the time the statute was passed.

The Eastland Court of Appeals, however, clearly affirms the holding of the San Antonio Court of Appeals in Mills v. Fletcher, 229 S.W.3d 765 (Tex.App.-San Antonio 2007, no pet.). While this case supported the application of the statute after the jury returned a verdict, it is still unclear as to whether a court must apply before or after the verdict.

City Council Election Deadlines

March 9– Last day for candidates to place names on the ballot.  As of today, Bob Dorsett, Jr., Steve Braasch, Stephen England, Jack McKool, Bill Goodwin, Rusty Kilgo filed for candidacy.

March 10 (5:30 p.m) – Conduct drawing at City Council for order of names on ballot.

March 16– Last day for a write-in candidate to declare candidacy.

March 17– Last day for candidate to withdraw.

April 9– Last day for submitting voter registration application to vote in this election.

April 24– Last day to receive application from voter in person for a ballot to be voted by mail.

April 27– First day of early voting by personal appearance.

May 1– Last day to receive application by mail for ballot to be voted by mail.

May 5– Last day of early voting by personal appearance.

May 9– Election day. Polls are open from 7 a.m.-7 p.m. at City Hall.
