A trucker was awarded $40,722 by a jury on April 8th after accusing Defendant of hitting him due to talking on her cell phone. Plaintiff claims that Defendant tried to make a turn into her driveway and hit him causing two bulging lumbar disks and a hernia keeping him out of work for 3 months. Plaintiff claims Defendant was distracted by her cell phone and Defendant says Plaintiff was speeding and not paying attention. Defendant was found negligent by a jury.
Collision-Ft. Worth, TX-Parking Lot-Defense Verdict
According to a jury, Defendant who was accused of carelessly backing out of a parking lot and hitting Plaintiff’s car in Arlington, did not cause crash. Plaintiff claimed the Defendant was backing out of the parking space and hit his car in which his passenger and himself were injured. The passenger incurred $120,000 in medical expenses claiming he sustained torn meniscus and neck and back herniations. The Plaintiff claimed he had back and neck strains with $40,000 of medical expenses. The Defendant said she was slowly backing out of the space and could not see because her view was blocked by a truck parked next to her and then Plaintiff sped by her very fast and she hit his car. The Plaintiff was found negligent on May 1st.
Product Liability-Hockley County-Conveyor Accident-Defense Verdict
There were no damages awarded to Plaintiff on July 7th for a welding accident. In 2002, Plaintiff had both legs amputated below the knee when a conveyor manufactured by Excel Machinery fell on him. Plaintiff claimed the conveyor should have extra support. Defendant argued that the employer mistreated the conveyor and did not repair it and was negligent.
Collision-Houston, TX- Parking Lot-$7,963 Verdict
On July 12th, a jury awarded $7,963 to a Plaintiff that was in her Mini Cooper and was struck by a pick up truck driven by Defendant. The truck was backing out in the parking lot. After going to the emergency room 11 days later, Plaintiff underwent MRI’s which showed cervical disk bulges. She underwent chiropractic treatment for 3 months.
Collision-Jefferson County-Rear-End-Settlement
A jury awarded $3,000 to Plaintiff who claimed he got back sprains in a minor rear-end. He said he had to do about 30 visits to the chiropractor and was asking for $25,000. Evidence was presented by the Defense that he had prior injuries in which he had seen a chiropractor about 70 times for the same injury and was receiving disability benefits.
Collision-Houston, TX- Drunk Driver-Settlement
A $150,000 settlement was agreed upon a week before trial on July 19th. In 2008, Plaintiff was a passenger in her brothers compact car when they were struck by Defendant. Defendant had a blood alcohol level of .24 and pleaded guilty to felony intoxication assault. Plaintiff suffered a comminuted fracture on her right humerous that required a metal plate.
Collision-Ft. Worth, TX- Man Knocked Over By Vehicle-Defense Verdict
A worker was knocked over by a rolling car while checking oil leaks in Defendants vehicle. Plaintiff was kneeling in front of Defendants vehicle in which Plaintiff said Defendant allowed vehicle to roll forward causing him lower back injuries and soft tissue injuries to the hip. Defendant claimed it was Plaintiff’s fault because he should have inspected from the side of the vehicle which was required by the employer. A jury declined damages to the worker on June 7th.
Collision-Houston, Texas- Fatality, Head on Crash, $1.6 Million Verdict
Family of Plaintiff was awarded $1.6 million on June 28th. In 2006, Plaintiff was driving when a pick-up truck driven by Defendant crossed the median and hit her. Plaintiff died on scene. Defendant was sued for gross negligence by husband. Plaintiff represented himself in front of the jury.
Collision-Dallas, County-Rear End- Both Parties Liable-$2,255 Recovered
Plaintiff claimed he struck Defendants van while he was stopped in the middle of the lane without his hazards on. Defendant was not questioned by the police and he also could not speak English but has claimed he was going 40-50 mph. The jury found Plaintiff 49% liable and Defendant 51% which reduced the award of $4,422 for minor injuries.
